Welcome to Move Your Spa.

The terms “we”, “us” and “our” refer to Move Your Spa. We operate this website and provide professional hot tub services including relocation, disposal, recycling, servicing, commissioning and storage.

Our website is hosted by Shopify, which enables us to provide our website and related online services to you.

These Terms of Service govern your use of our website. Where you request a quotation or book a service with us, your booking will also be subject to the specific Terms & Conditions provided with your quotation or booking confirmation.

Please read these Terms carefully before using our website or booking a service.

By accessing or using our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree with them, you should not use our website.

1. Using our website

You may use our website only for lawful purposes.

When submitting an enquiry, requesting a quotation or making a booking, you agree that the information you provide will be accurate, complete and up to date.

This is particularly important where information is used to assess or quote for a service, including hot tub dimensions, location, access measurements, photographs, videos, parking arrangements and information about any restrictions or obstacles.

You must not misuse our website, attempt to interfere with its operation or security, introduce malicious software, attempt to gain unauthorised access to any part of the website, or use it for any unlawful or fraudulent purpose.

2. Our services and quotations

We make every reasonable effort to describe our services accurately on our website. Information provided on the website is intended as general information and does not constitute a quotation or guarantee that a particular service can be completed at a particular property.

Quotations are prepared using the information provided to us by the customer. Prices and feasibility may depend on factors including the size and condition of the hot tub, access at the property, distance travelled, equipment required, number of engineers required and any third-party services such as crane hire.

A quotation does not constitute acceptance of a booking until we have confirmed the booking and any applicable Preparation Fee has been paid.

Acceptance of a booking based on photographs, videos or measurements does not guarantee that the work can be completed if actual site conditions are materially different from the information supplied or if our team considers the work unsafe or impractical on arrival.

3. Service-specific Terms & Conditions

Hot tub relocation, disposal and other services may have additional Terms & Conditions which will be provided with your quotation, booking confirmation or otherwise made available to you before the service.

These service-specific Terms & Conditions form part of the agreement between you and Move Your Spa.

They contain important information relating to matters including:

  • preparation of the hot tub;

  • access requirements;

  • customer responsibilities;

  • service times and additional charges;

  • payment arrangements;

  • cancellations and postponements;

  • failed attendances;

  • crane and third-party services;

  • installation or commissioning requirements;

  • the condition of the hot tub; and

  • risks associated with moving previously used hot tubs.

Where a service-specific term relates directly to a service you have booked, that term will take precedence over these general Terms of Service in relation to that booking.

4. Prices and payment

Prices shown on our website are indicative unless expressly stated otherwise. The price payable for a booked service will be the price confirmed in your quotation or booking documentation, together with any additional charges that become payable under the applicable service Terms & Conditions.

Prices are subject to VAT unless otherwise stated.

Certain services require a Preparation Fee to secure the booking and allow us to begin administrative, planning and logistical work.

The amount of the Preparation Fee, the balance payable, accepted payment methods and the time at which payment becomes due will be set out in your quotation and applicable service Terms & Conditions.

Additional charges may apply where additional time, labour, equipment, mileage, storage, access work, crane services or other resources are required. Where applicable, these charges will be dealt with in accordance with the Terms & Conditions for the service you have booked.

5. Cancellations, cooling-off rights and refunds

If you are a consumer booking a service at a distance, you may have a statutory right to cancel your contract within 14 days of entering into it.

Where you expressly ask us to begin preparatory work or provide part of the service during this period, you may be required to pay for work already carried out before you tell us that you wish to cancel, where permitted by law.

Where a service has been fully performed during the cancellation period following your express request and acknowledgement, your statutory right to cancel may end once the service has been completed.

After any applicable statutory cancellation period has expired, cancellations and postponements will be dealt with in accordance with the Terms & Conditions for the service you have booked.

Nothing in these Terms affects your statutory consumer rights.

6. Access and customer responsibilities

Many of our services depend on suitable and safe access to the hot tub and property.

You are responsible for providing accurate and complete information about access and for preparing the hot tub and access route as required by the applicable service Terms & Conditions.

This may include providing measurements, photographs and videos, removing obstacles, ensuring appropriate parking or vehicle access and ensuring any agreed additional assistance is available.

If we attend a property and cannot safely carry out the service because information supplied was inaccurate or incomplete, access was unsuitable or not prepared, required assistance was unavailable, the hot tub was not appropriately prepared, or another issue that should reasonably have been resolved before our arrival prevents the work from being carried out, this may be treated as a failed attendance.

Charges for failed attendances and any additional costs will be dealt with in accordance with the applicable service Terms & Conditions.

Our team always retains the right to refuse to carry out work which they reasonably consider unsafe.

7. Third-party services

Some bookings may require services supplied by third parties, such as crane providers.

Where we introduce or recommend a third-party provider, that provider is an independent business. Unless expressly stated otherwise, any agreement for their services is between you and the third-party provider.

We are not responsible for the pricing, availability, actions, omissions, workmanship, insurance, delays or cancellation terms of independent third-party providers.

Any fees imposed by a third-party provider as a result of cancellation, postponement, failed attendance, access problems or other circumstances will normally be your responsibility.

8. Delays and circumstances outside our control

We will make reasonable efforts to provide booked services on the agreed date and at the expected time.

However, hot tub movements take place across the UK and may be affected by circumstances outside our reasonable control, including severe weather, traffic disruption, road closures, vehicle breakdowns, staff absence and other unforeseen events.

Where such circumstances affect a booking, we will make reasonable efforts to notify you and, where appropriate, arrange an alternative date.

Unless required by law, we will not be responsible for losses or third-party costs arising solely from events outside our reasonable control.

9. Providing our services

We will provide our services with reasonable care and skill.

Hot tubs are large, complex items containing plumbing, electrical components, seals, fittings and other internal parts. Moving an existing or ageing hot tub can expose pre-existing deterioration, latent faults or weaknesses that were not apparent before movement.

Specific provisions relating to the condition of a hot tub, inspections, photographs, existing damage, leaks, plumbing and internal components are contained in our Hot Tub Relocation Terms & Conditions.

Nothing in these Terms excludes or restricts our responsibility where loss or damage has been caused by our failure to exercise reasonable care and skill, our negligence, fraud or fraudulent misrepresentation, or where liability cannot legally be excluded or restricted.

Nothing in these Terms affects your statutory rights as a consumer.

10. Information on our website

We make reasonable efforts to ensure that the information on our website is accurate and up to date.

Occasionally, information may contain typographical errors, inaccuracies or omissions relating to matters such as service descriptions, prices, availability, promotions or other information.

We reserve the right to correct errors and update information without prior notice.

Website content is provided for general information and should not be relied upon as a substitute for information specifically provided to you in a quotation or booking confirmation.

11. Intellectual property

Unless otherwise stated, the content of this website, including our branding, logo, text, photographs, videos, graphics, designs and other materials, is owned by or licensed to Move Your Spa and is protected by applicable intellectual property laws.

You may access and use our website for personal, non-commercial purposes.

You may not reproduce, copy, republish, distribute, modify, commercially exploit or otherwise use our website content without our prior written permission, except where permitted by law.

The Shopify name, logo and related trademarks belong to Shopify. Other names and trademarks appearing on our website belong to their respective owners.

12. Third-party links and tools

Our website may contain links to websites, services or tools operated by third parties.

We do not control those third-party websites and are not responsible for their content, availability, security, privacy practices or services.

Your use of third-party websites and services is subject to the terms and policies of the relevant third party.

13. Relationship with Shopify

Move Your Spa is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Move Your Spa.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Move Your Spa, including any injury, damage or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Move Your Spa.

14. Privacy

Any personal information we collect through our website is handled in accordance with our Privacy Policy.

Because our website is hosted by Shopify, Shopify may also collect and process information relating to your use of the website in order to provide its services to us.

We are not responsible for losses that were not reasonably foreseeable, were not caused by our breach, or arise from circumstances outside our reasonable control.

Unless we have expressly agreed otherwise, our website and services are provided for private and domestic use. If you use them for business or commercial purposes, we will not be responsible for loss of profit, loss of business, loss of business opportunity or business interruption to the extent permitted by law.

19. Severability and waiver

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary and the remaining provisions will continue in effect.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

20. Entire agreement and order of precedence

These Terms, together with our Privacy Policy, Returns, Cancellations & Refunds Policy, your quotation, booking confirmation and any applicable service-specific Terms & Conditions, form the agreement between you and Move Your Spa in relation to your use of the website and any service you book.

Where there is a conflict relating specifically to the performance of a booked service, the applicable service-specific Terms & Conditions and your confirmed quotation will take precedence over these general website Terms.

Nothing in this section limits any statutory rights which cannot lawfully be excluded or restricted.

21. Governing law

These Terms are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights you may have as a consumer to bring proceedings in another part of the United Kingdom or another jurisdiction.

We may update these Terms of Service from time to time, including where our services, website, business practices or legal obligations change.

The most current version will be available on this page.

Changes will not retrospectively alter the terms of an existing confirmed booking unless permitted by law or agreed with you.
